Select Comfort Sleep Number® Bed Class Action Litigation

Bustamante O'Hara & Gagliasso has filed a class action against Select Comfort Retail Corporation, the manufacturer, distributor and seller of the Sleep Number® bed. The Sleep Number® bed was designed to give the owner a "perfect night's sleep." However, some people who have used the Sleep Number® bed have become ill, suffering from allergies, hypersensitivity, pulmonary distress and/or other bronchial problems. When they unzipped the top cover of their beds to look between the foam insert and the air baffles, they discovered mold infestation on the baffles and underside of the foam. These problems are known to exist in beds that were sold between 1987 to the present.

The Sleep Number® bed was sold through Select Comfort's retail stores and through its website; and through retail stores such as Bed, Bath & Beyond, Sleep Train, and Mattress Discounters.

The suit, filed in The United States District Court, Northern District of California, is brought on behalf of all individuals who purchased or used Sleep Number® beds between 1987 to the present in California and Florida. The suit seeks compensation for purchasers or users of the Sleep Number® bed. The Complaint alleges that Select Comfort has known about the inherently defective Sleep Number® bed for a significant period of time and failed to notify purchasers of the defect or take any action to recall the beds.

Purchasers of the beds are being told by Select Comfort to accept replacement parts or to return the beds, often at a significant cost to the purchaser. The Class Action seeks not only to have Select Comfort provide notice to purchasers that its Sleep Number® bed is subject to mold infestation, but also to have the class members compensated for losses they may have suffered.
